Abstrakt
A lease agreement is a commonly concluded agreement, especially in relations connected with agriculture. Most often, the relationship between the lessor and the lessee concerns agricultural real estate or farms. The author analyzes the provisions regarding the lease agreement resulting from the Civil Code and applies them to agricultural real estate. Considerations include aspects concerning the legal situation of both the lessor and the lessee, with particular emphasis on their rights and obligations. According to the author, the lease agreement is of fundamental importance for trade in agricultural real estate. It seems interesting that the different varieties of the lease agreement exist due to the entity participating in the contract as a leaseholder, as well as taking into account the difference resulting from the circumstances, whether the property belongs to a private person or comes from the Agricultural Property Stock of the State Treasury. The author will first introduce the concepts of agricultural real estate and agricultural holding. Next, the author will discuss the essentialia of the lease agreement, i.e. the parties to the contractual relationship, the rights and obligations of the parties, as well as the subject of the contract. And finally, the contract for the lease of agricultural real estate will be discussed, which is the most important contract from the point of view of this article. However, it will be preceded by an analysis of the provisions on agricultural real estate resulting from the Act on shaping the agricultural system and the concept of an individual farmer. The author will try to discuss individual regulations and assess their legitimacy from the point of view of a person who is a party to such a contract.
